These Terms of Service (“Terms”) govern your access to and use of www.miracletree.org and all related services, products, and functionality offered by Miracle Tree (“we,” “us,” or “our”).

By accessing, browsing, or using our website, or by placing an order, you agree to be bound by these Terms and our:

1. Eligibility & Acceptable Use

• Acknowledge that payments are processed via third-party providers (e.g., Shopify Payments, Stripe)

We reserve the right to cancel or refuse any order, including for suspected fraud or pricing errors.

3. Pricing & Availability

Prices may change at any time without notice.

We reserve the right to:

• Modify or discontinue products
• Correct pricing or typographical errors
• Limit quantities or cancel orders

4. Shipping, Returns & Cancellations

All shipping, returns, refunds, and cancellations are governed exclusively by our:

You agree not to initiate chargebacks outside these policies. Doing so may result in account suspension or denial of future service.

5. Subscriptions, Pre-Orders & Promotions

Where applicable:

• Subscription billing terms, renewal terms, and cancellation conditions are disclosed at checkout
• Pre-orders are charged as disclosed and may have extended fulfillment timelines
• Promotions and discount codes cannot be applied retroactively

6. Intellectual Property

All content on this website—including text, images, branding, product designs, and software—is owned by Miracle Tree or its licensors and protected by law.

You may not copy, reproduce, distribute, or exploit content without written consent.

7. User Content & Reviews

You may submit reviews, ratings, photographs, comments, and other content to our website. You keep ownership of everything you submit.

By submitting content, you grant Miracle Tree a worldwide, royalty-free, non-exclusive licence to use, host, store, reproduce, adapt, crop, excerpt, translate, publish, publicly display, and distribute that content for the purpose of operating, marketing, and promoting our business and our products, in any medium. This licence includes the right to sublicense those rights to the service providers and platforms we rely on to host, display, syndicate, or moderate customer content, such as our review platform, our online store, and the retail marketplaces our products are listed on.

You can withdraw this licence at any time. Write to info@miracletree.org and we will stop using the content and remove it from the surfaces we control within a reasonable period. Withdrawal does not reach copies already distributed to or cached by third parties, printed material already produced, or content we can no longer identify as yours. Nothing in this section limits any right you have under our Privacy Policy or under applicable data protection law to have your personal information deleted; where those rights apply, they prevail over this licence.

We are under no obligation to use, publish, or keep publishing anything you submit, and we may decline or remove content that is unlawful, misleading, or off-topic. We do not pay for submitted content unless we have agreed otherwise in writing.

You represent that the content is yours to submit, that it does not infringe anyone else's rights, and that any person identifiable in a photograph you submit has agreed to its use as described above.

To the extent permitted by applicable law, you agree not to assert moral rights in the content in a way that would prevent the uses described above. Where those rights cannot be waived, this paragraph does not apply to you.

8. Prohibited Conduct

You agree not to:

• Use the site for unlawful purposes
• Interfere with site functionality or security
• Submit false or misleading information
• Attempt to bypass safeguards or exploit vulnerabilities

9. Disclaimer of Warranties

13. Fraud Prevention & Chargeback Protection

We actively monitor transactions for fraud.

By purchasing, you agree that we may:

• Verify payment and identity information
• Use order, delivery, IP, and communication records as evidence in disputes
• Deny claims inconsistent with our published policies

14. Consumers in the European Union, EEA and United Kingdom

This section applies if you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom. Where it conflicts with any other provision of these Terms or of our other policies, this section prevails.

• Statutory rights are not waived. Nothing in these Terms or in any of our policies limits, excludes, or modifies any right or remedy that applicable consumer protection law gives you and that cannot lawfully be waived, including statutory rights relating to goods that are faulty, damaged, or not as described.
• 14-day right of withdrawal. Under Directive 2011/83/EU on consumer rights, as implemented in your country and as retained in United Kingdom law, you may withdraw from a distance purchase within 14 days of the day on which you, or a third party indicated by you, take physical possession of the goods, without giving any reason. To exercise this right, send a clear statement of your decision to info@miracletree.org before that period expires.
• Effect of withdrawal. You must return the goods without undue delay and in any event within 14 days of telling us. We will reimburse all payments received from you, including the cost of standard delivery, without undue delay and in any event within 14 days of the day we are informed of your decision, although we may withhold reimbursement until we have received the goods back or you have supplied evidence of return. You bear the direct cost of returning the goods and may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
• Sealed goods exception. The right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons and that were unsealed after delivery (Article 16(e) of Directive 2011/83/EU). Goods that are still in their original, unopened sealed packaging are not covered by this exception and may be returned within the 14-day period described above. This is the only basis on which opened consumable products are treated as non-returnable for consumers covered by this section.
• Forum. The governing-law and venue provisions in Section 15 do not deprive you of the protection of the mandatory rules of the country in which you are habitually resident, and do not prevent you from bringing proceedings before the courts of that country where applicable law gives you that right.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Talk to us first. Before either of us files a claim, we each agree to try to resolve the dispute informally. Send a short written description of the problem and the outcome you want to info@miracletree.org; if we are the one raising the dispute, we will send the same to the email address on your account. We each then have 30 days to respond and to try in good faith to resolve it. This step is a courtesy and not a precondition: it does not prevent either of us from going to court, or to a small claims court, at any time, and those 30 days do not count against any deadline you have for bringing a claim.

Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. Nothing in this section prevents either party from bringing an individual claim in a small claims court of competent jurisdiction.

To the fullest extent permitted by applicable law, each party agrees to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. This paragraph does not apply where it is unenforceable under applicable law, and does not apply to consumers covered by Section 14.

These Terms contain no agreement to arbitrate, and we do not require you to submit disputes with us to binding arbitration.

16. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including:

• Natural disasters
• Supply chain disruptions
• Carrier delays
• Government actions

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

18. Entire Agreement

These Terms, together with our policies, constitute the entire agreement between you and Miracle Tree.

19. Changes to Terms

We may update these Terms at any time. Continued use of the website constitutes acceptance of updated Terms.
